1Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsuredexceptasprovidedinClauses4,5,6and7below.

2Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofaffreightmentand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClauses4,5,6and7orelsewhereinthisinsurance.

3ThisinsuranceisextendedtoindemnifytheAssuredagainstsuchproportionofliabilityunderthecontractofaffreightment“BothtoBlameCollision”Clauseasisinrespectofalossrecoverablehereunder.IntheeventofanyclaimbyshipownersunderthesaidClausetheAssuredagreetonotifytheUnderwriterswhoshallhavetheright,attheirowncostandexpense,todefendtheAssuredagainstsuchclaim.

EXCLUSIONS

4Innocaseshallthisinsurancecover

4.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured

4.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured

4.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause4.3“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)

4.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

4.5lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst(exceptexpensespayableunderClause2above)

4.6lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevessel

4.7lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.

5.5.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfromunseaworthinessofvesselorcraftunfitnessofvesselcraftconveyancecontainerorliftvanforthesafecarriageofthesubject-matterinsured,wheretheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein.

5.2TheUnderwriterswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination,unlesstheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness.

6Innocaseshallthisinsurancecoverlossdamageorexpensecausedby

6.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower

6.2captureseizurearrestrestraintordetainment(piracyexcepted),andtheconsequencesthereoforanyattemptthereat

6.3derelictminestorpedoesbombsorotherderelictweaponsofwar.

7Innocaseshallthisinsurancecoverlossdamageorexpense

7.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions

7.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions

7.3causedbyanyterroristoranypersonactingfromapoliticalmotive.

DURATION

8.8.1Thisinsuranceattachesfromthetimethegoodsleavethewarehouseorplaceofstorageattheplacenamedhereinforthecommencementofthetransit,continuesduringtheordinarycourseoftransitandterminateseither

8.1.1ondeliverytotheConsignees’orotherfinalwarehouseorplaceofstorageatthedestinationnamedherein,

8.1.2ondeliverytoanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedherein,whichtheAssuredelecttouseeither

8.1.2.1forstorageotherthanintheordinarycourseoftransitor

8.1.2.2forallocationordistribution,or

8.1.3ontheexpiryof60daysaftercompletionofdischargeoversideofthegoodsherebyinsuredfromtheoverseavesselatthefinalportofdischarge,whichevershallfirstoccur.

8.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischargebutpriortoterminationofthisinsurance,thegoodsaretobeforwardedtoadestinationotherthanthattowhichtheyareinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidedforabove,shallnotextendbeyondthecommencementoftransittosuchotherdestination.

8.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforaboveandtotheprovisionsofClause9below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.

9IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthegoodsasprovidedforinClause8above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheUnderwriters,either

9.1untilthegoodsaresoldanddeliveredatsuchportorplace,or,unlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthegoodsherebyinsuredatsuchportorplace,whichevershallfirstoccur,

or

9.2ifthegoodsareforwardedwithinthesaidperiodof60days(oranyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause8above.

10Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.

CLAIMS

11.11.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.

11.2Subjectto11.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.

12Where,asaresultoftheoperationofariskcoveredbythisinsurance,theinsuredtransitisterminatedataportorplaceotherthanthattowhichthesubject-matteriscoveredunderthisinsurance,theUnderwriterswillreimbursetheAssuredforanyextrachargesproperlyandreasonablyincurredinunloadingstoringandforwardingthesubject-mattertothedestinationtowhichitisinsuredhereunder.

ThisClause12,whichdoesnotapplytogeneralaverageorsalvagecharges,shallbesubjecttotheexclusionscontainedinClauses4,5,6and7above,andshallnotincludechargesarisingfromthefaultnegligenceinsolvencyorfinancialdefaultoftheAssuredortheirservants.

13NoclaimforConstructiveTotalLossshallberecoverablehereunderunlessthesubject-matterinsuredisreasonablyabandonedeitheronaccountofitsactualtotallossappearingtobeunavoidableorbecausethecostofrecovering,reconditioningandforwardingthesubject-mattertothedestinationtowhichitisinsuredwouldexceeditsvalueonarrival.

14.14.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargoinsuredhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.

IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

14.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:

TheagreedvalueofthecargoshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossandeffectedonthecargobytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.

IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

BENEFITOFINSURANCE

15Thisinsuranceshallnotinuretothebenefitofthecarrierorotherbailee.

MINIMISINGLOSSES

16ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflossrecoverablehereunder

16.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and

16.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercisedandtheUnderwriterswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.

17MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.

AVOIDANCEOFDELAY

18ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.

19ThisinsuranceissubjecttoEnglishlawandpractice.
