QUALIFYINGVESSELS
1).Thisinsuranceandthemarinetransitratesasagreedinthepolicyoropencoverapplyonlytocargoesand/orinterestscarriedbymechanicallyself-propelledvesselsofsteelconstructionclassedwithaClassificationSocietywhichis:
1.1.aMemberorAssociateMemberoftheInternationalAssociationofClassificationSocieties(IACS*),or
1.2.aNationalFlagSocietyasdefinedinClause4below,butonlywherethevesselisengagedexclusivelyinthecoastaltradingofthatnation(includingtradingonaninter-islandroutewithinanarchipelagoofwhichthatnationformspart).Cargoesand/orinterestscarriedbyvesselsnotclassedasabovemustbenotifiedpromptlytounderwritersforratesandconditionstobeagreed.Shouldalossoccurpriortosuchagreementbeingobtainedcovermaybeprovidedbutonlyifcoverwouldhavebeenavailableatareasonablecommercialmarketrateonreasonablecommercialmarketterms.
AGELIMITATION
2).Cargoesand/orinterestscarriedbyQualifyingVessels(asdefinedabove)whichexceedthefollowingagelimitswillbeinsuredonthepolicyoropencoverconditionssubjecttoanadditionalpremiumtobeagreed.Bulkorcombinationcarriersover10yearsofageorothervesselsover15yearsofageunlessthey:
2.1.havebeenusedforthecarriageofgeneralcargoonanestablishedandregularpatternoftradingbetweenarangeofspecifiedports,anddonotexceed25yearsofage,or
2.2.wereconstructedascontainerships,vehiclecarriersordouble-skinopen-hatchgantrycranevessels(OHGCs)andhavebeencontinuouslyusedassuchonanestablishedandregularpatternoftradingbetweenarangeofspecifiedports,anddonotexceed30yearsofage.
CRAFTCLAUSE
3).TherequirementsofthisClausedonotapplytoanycraftusedtoloadorunloadthevesselwithintheportarea.
NATIONALFLAGSOCIETY
4).ANationalFlagSocietyisaClassificationSocietywhichisdomiciledinthesamecountryastheownerofthevesselinquestionwhichmustalsooperateundertheflagofthatcountry.
PROMPTNOTICE
5).WherethisinsurancerequirestheassuredtogivepromptnoticetotheUnderwriters,therighttocoverisdependentuponcompliancewiththatobligation.
LAWANDPRACTICE
6).ThisinsuranceissubjecttoEnglishlawandpractice.
