1Thisinsurancecovers,exceptasprovidedinClauses3and4below,lossofordamagetothesubject-matterinsuredcausedby

1.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower

1.2captureseizurearrestrestraintordetainment,arisingfromriskscoveredunder1.1above,andtheconsequencesthereoforanyattemptthereat

1.3derelictminestorpedoesbombsorotherderelictweaponsofwar.

2Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofaffreightmentand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromariskcoveredundertheseclauses.

EXCLUSIONS

3Innocaseshallthisinsurancecover

3.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured

3.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured

3.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause3.3“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)

3.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

3.5lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst(exceptexpensespayableunderClause2above)

3.6lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevessel.

3.7Anyclaimbaseduponlossoforfrustrationofthevoyageoradventure

3.8Lossdamageorexpensearisingfromanyhostileuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.

4.4.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfromunseaworthinessofvesselorcraft,unfitnessofvesselcraftconveyancecontainerorliftvanforthesafecarriageorthesubject-matterinsured,wheretheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein.

4.2TheUnderwriterswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination,unlesstheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness.

DURATION

5.5.1Thisinsurance

5.1.1attachesonlyasthesubject-materinsuredandastoanypartasthatpartisloadedonanoverseavesseland

5.1.2terminates,subjectto5.2and5.3below,eitherasthesubject-matterinsuredandastoanypartasthatpartisdischargedfromanoverseavesselatthefinalportorplaceofdischarge,oronexpiryof15dayscountingfrommidnightofthedayofarrivalofthevesselatthefinalportorplaceofdischarge,whichevershallfirstoccur.nevertheless,subjecttopromptnoticetotheUnderwritersandtoanadditionalpremium,suchinsurance

5.1.3reattacheswhen,withouthavingdischargedthesubject-matterinsuredatthefinalportorplaceofdischarge,thevesselsailstherefrom,

5.1.4terminates,subjectto5.2and5.3below,eitherasthesubject-matterinsuredandastoanypartasthatpartisthereafterdischargedfromthevesselatthefinal(orsubstituted)portorplaceofdischarge,oronexpiryof15dayscountingfrommidnightofthedayofre-arrivalofthevesselatthefinalportorplaceofdischargeorarrivalofthevesselatasubstitutedportorplaceofdischarge,whichevershallfirstoccur.

5.2Ifduringtheinsuredvoyagetheoverseavesselarrivesatanintermediateportorplacetodischargethesubject-matterinsuredforon-carriagebyoverseavesselorbyaircraft,orthegoodsaredischargedfromthevesselataportorplaceofrefuge,then,subjectto5.3belowandtoanadditionalpremiumifrequired,thisinsurancecontinuesuntiltheexpiryof15dayscountingfrommidnightofthedayofarrivalofthevesselatsuchportorplace,butthereafterreattachesasthesubject-matterinsuredandastoanypartasthatpartisloadedonanon-carryingoverseavesseloraircraft.Duringtheperiodof15daystheinsuranceremainsinforceafterdischargeonlywhilstthesubject-matterinsuredandastoanypartasthatpartisatsuchportorplace.Ifthegoodsareon-carriedwithinthesaidperiodof15daysoriftheinsurancereattachesasprovidedinthisClause5.2

5.2.1wheretheon-carriageisbyoverseavesselthisinsurancecontinuessubjecttothetermsoftheseclauses,or

5.2.2wheretheon-carriageisbyaircraft,thecurrentInstituteWarClauses(AirCargo)(excludingsendingsbyPost)shallbedeemedtoformpartofthisinsuranceandshallapplytotheon-carriagebyair.

5.3Ifthevoyageinthecontractofcarriageisterminatedataportorplaceotherthanthedestinationagreedtherein,suchportorplaceshallbedeemedthefinalportofdischargeandsuchinsuranceterminatesinaccordancewith5.1.2.Ifthesubject-matterinsuredissubsequentlyreshippedtotheoriginaloranyotherdestination,thenprovidednoticeisgiventotheUnderwritersbeforethecommencementofsuchfurthertransitandsubjecttoanadditionalpremium,suchinsurancereattaches5.3.1inthecaseofthesubject-matterinsuredhavingbeendischarged,asthesubject-matterinsuredandastoanypartasthatpartisloadedontheon-carryingvesselforthevoyage;

5.3.2inthecaseofthesubject-matternothavingbeendischarged,whenthevesselsailsfromsuchdeemedfinalportofdischarge;thereaftersuchinsuranceterminatesinaccordancewith5.1.4.

5.4Theinsuranceagainsttherisksofminesandderelicttorpedoes,floatingorsubmerged,isextendedwhilstthesubject-matterinsuredoranypartthereofisoncraftwhilstintransittoorfromtheoverseavessel,butinnocasebeyondtheexpiryof60daysafterdischargefromtheoverseavesselunlessotherwisespeciallyagreedbytheUnderwriters.

5.5SubjecttopromptnoticetoUnderwriters,andtoanadditionalpremiumifrequired,thisinsuranceshallremaininforcewithintheprovisionsoftheseClausesduringanydeviation,oranyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.(ForthepurposeofClause5“arrival”shallbedeemedtomeanthatthevesselisanchored,mooredorotherwisesecuredataberthorplacewithintheHarbourAuthorityarea.Ifsuchaberthorplaceisnotavailable,arrivalisdeemedtohaveoccurredwhenthevesselfirstanchors,moorsorotherwisesecureseitheratorofftheintendedportorplaceofdischarge“overseavessel”shallbedeemedtomeanavesselcarryingthesubject-matterfromoneportorplacetoanotherwheresuchvoyageinvolvesaseapassagebythatvessel)

6Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.

7AnythingcontainedinthiscontractwhichisinconsistentwithClauses3.7,3.8or5shall,totheextentofsuchinconsistency,benullandvoid.

CLAIMS

8.8.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.

8.2Subjectto8.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.

9.9.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargoinsuredhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

9.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:

TheagreedvalueofthecargoshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossandeffectedonthecargobytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

BENEFITOFINSURANCE

10Thisinsuranceshallnotinuretothebenefitofthecarrierorotherbailee.

MINIMISINGLOSSES

11ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflossrecoverablehereunder

11.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and

11.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercisedandtheUnderwriterswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.

12MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.

AVOIDANCEOFDELAY

13ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.
