1Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsuredexceptasprovidedinClauses 2,3and4below.
EXCLUSIONS
2Innocaseshallthisinsurancecover
2.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured
2.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured
2.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthe subject-matterinsured(forthepurposeofthisClause2.3“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)
2.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured
2.5lossdamageorexpensearisingfromunfitnessofaircraftconveyancecontainerorliftvanforthesafecarriageofthesubject-matterinsured,wheretheAssuredortheirservantsareprivytosuchunfitness atthetimethesubject-matterinsuredisloadedtherein
2.6lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst
2.7lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterers oroperatorsoftheaircraft
2.8lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfission and/orfusionorotherlikereactionorradioactiveforceormatter.
3Innocaseshallthisinsurancecoverlossdamageorexpensecausedby
3.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower
3.2captureseizurearrestrestraintordetainment(piracyexcepted),andtheconsequencesthereoforany attemptthereat
3.3derelictminestorpedoesbombsorotherderelictweaponsofwar.
4Innocaseshallthisinsurancecoverlossdamageorexpense
4.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivil commotions
4.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions
4.3causedbyanyterroristoranypersonactingfromapoliticalmotive.
DURATION
55.1Thisinsuranceattachesfromthetimethesubject-matterinsuredleavesthewarehouse,premisesorplaceofstorageattheplacenamedhereinforthecommencementofthetransit,continuesduringthe ordinarycourseoftransitandterminateseither
5.1.1ondeliverytotheConsignees’orotherfinalwarehouse,premisesorplaceofstorageatthe destinationnamedherein,
5.1.2ondeliverytoanyotherwarehouse,premisesorplaceofstorage,whetherpriortooratthe destinationnamedherein,whichtheAssuredelecttouseeither
5.1.2.1forstorageotherthanintheordinarycourseoftransitor
5.1.2.2forallocationordistributionor
5.1.3ontheexpiryof30daysafterunloadingthesubject-matterinsuredfromtheaircraftatthefinalplace ofdischarge,whichevershallfirstoccur.
5.2If,afterunloadingfromtheaircraftatthefinalplaceofdischarge,butpriortoterminationofthisinsurance,thesubject-matterinsuredisforwardedtoadestinationotherthanthattowhichitisinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidedforabove,shallnotextend beyondthecommencementoftransittosuchotherdestination.
5.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforaboveandtotheprovisionsofClause6below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofa libertygrantedtotheaircarriersunderthecontractofcarriage.
6IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthesubject-matterinsuredasprovidedforinClause5above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremainin force,subjecttoanadditionalpremiumifrequiredbytheUnderwriters,either
6.1untilthesubject-matterissoldanddeliveredatsuchplaceor,unlessotherwisespeciallyagreed,untiltheexpiryof30daysafterarrivalofthesubject-matterherebyinsuredatsuchplace,whichevershallfirstoccur,or
6.2ifthesubject-matterisforwardedwithinthesaidperiodof30days(oranyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause5above.
7Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.
CLAIMS
88.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss
8.2Subjectto8.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.
9Where,asaresultoftheoperationofariskcoveredbythisinsurance,theinsuredtransitisterminatedataplaceotherthanthattowhichthesubject-matteriscoveredunderthisinsurance,theUnderwriterswillreimbursetheAssuredforanyextrachargesproperlyandreasonablyincurredinunloadingstoringandforwardingthesubjectmattertothedestinationtowhichitisinsuredhereunder.ThisClause9,whichdoesnotapplytogeneralaverageorsalvagecharges,shallbesubjecttotheexclusionscontainedinClauses2,3and4above,andshallnotincludechargesarisingfromthefaultnegligenceinsolvencyorfinancialdefaultoftheAssuredortheirservants.
10NoclaimforconstructiveTotalLossshallberecoverablehereunderunlessthesubject-matterinsuredisreasonablyabandonedeitheronaccountofitsactualtotallossappearingtobeunavoidableorbecausethecostofrecovering,reconditioningandforwardingthesubject-mattertothedestinationtowhichitisinsuredwouldexceeditsvalueonarrival.
11.11.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargoinsuredhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.
11.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:TheagreedvalueofthecargoshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossandeffectedonthecargobytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.
BENEFITOFINSURANCE
12Thisinsuranceshallnotinuretothebenefitofthecarrierorotherbailee.
MINIMISINGLOSSES
13ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflossrecoverablehereunder
13.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and
13.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercisedandtheUnderwriterswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.
14MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.
AVOIDANCEOFDELAY
15ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.

16ThisinsuranceissubjecttoEnglishlawandpractice.
