EXCLUSIONS

2Innocaseshallthisinsurancecover

2.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured

2.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured

2.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClauses2.3“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)

2.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

2.5lossdamageorexpensearisingfromunfitnessofaircraftconveyancecontainerorliftvanforthesafecarriageorthesubject-matterinsured,wheretheAssuredortheirservantsareprivytosuchunfitnessatthetimethesubject-matterinsuredisloadedtherein

2.6lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst

2.7lossdamageorexpensearisingforminsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsoftheaircraft

2.8lossdamageorexpensearisingformtheabsenceshortageorwithholdingoflabourofanydescriptionwhatsoeverresultingfromanystrike,lockout,labourdisturbance,riotorcivilcommotion

2.9lossdamageorexpensearisingformtheuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceofmatter

2.10lossdamageorexpensecausedbywarcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower.

DURATION

3.3.1Thisinsuranceattachesformthetimethesubject-matterinsuredleavesthewarehouse,premisesorplaceofstorageattheplacenamedhereinforthecommencementofthetransit,continuesduringtheordinarycourseoftransitandterminateseither

3.1.1ondeliverytotheConsignees’orotherfinalwarehouse,premisesorplaceofstorageatthedestinationnamedherein

3.1.2ondeliverytoanyotherwarehouse,premisesorplaceofstorage,whetherpriortooratthedestinationnamedherein,whichtheAssuredelecttouseeither

3.1.2.1forstorageotherthanintheordinarycourseoftransitor

3.1.2.2forallocationordistributionor

3.1.3ontheexpiryof30daysafterunloadingthesubject-matterinsuredfromtheaircraftatthefinalplaceofdischarge,whichevershallfirstoccur.

3.2If,afterunloadingformtheaircraftatthefinalplaceofdischarge,butpriortoterminationofthisinsurance,thesubject-matterinsuredisforwardedtoadestinationotherthanthattowhichitisinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidedforabove,shallnotextendbeyondthecommencementoftransittosuchotherdestination.

3.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforaboveandtotheprovisionsofClause4below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingformtheexerciseofalibertygrantedtotheaircarriersunderthecontractofcarriage.

4IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthesubject-matterinsuredasprovidedforinClause3above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheUnderwriters,either

4.1untilthesubject-matterissoldanddeliveredatsuchplaceor,unlessotherwisespeciallyagreed,untiltheexpiryof30daysafterarrivalofthesubject-matterherebyinsuredatsuchplace,whichevershallfirstoccur,

4.2ifthesubject-matterisforwardedwithinthesaidperiodof30days(oranyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause3above.

5Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.

CLAIMS

6.6.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubjectmatterinsuredatthetimeoftheloss.

6.2Subjectto6.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.

7.7.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargoinsuredhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

7.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:TheagreedvalueofthecargoshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossandeffectedonthecargobytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

BENEFITOFINSURANCE

8Thisinsuranceshallnotinuretothebenefitofthecarrierorotherbailee.

MINIMISINGLOSSES

9ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflossrecoverablehereunder

9.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and

9.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercisedandtheUnderwriterswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.

10MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.

AVOIDANCEOFDELAY

11ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.
