1.2captureseizurearrestrestraintordetainment,arisingfromriskscoveredunder1.1above,andtheconsequencesthereoforanyattemptthereat

1.3derelictminestorpedoesbombsorotherderelictweaponsofwar.

EXCLUSIONS

2Innocaseshallthisinsurancecover

2.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured

2.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured

2.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause2.3“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)

2.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

2.5lossdamageorexpensearisingfromunfitnessofaircraftconveyancecontainerorliftvanforthesafecarriageofthesubject-matterinsured,wheretheAssuredortheirservantsareprivytosuchunfitnessatthetimethesubject-matterinsuredisloadedtherein

2.6lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst

2.7lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsoftheaircraft

2.8anyclaimbaseduponlossoforfrustrationofthevoyageoradventure

2.9lossdamageorexpensearisingfromanyhostileuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.

DURATION

33.1Thisinsurance

3.1.1attachesonlyasthesubject-matterinsuredandastoanypartasthatpartisloadedontheaircraftforthecommencementoftheairtransitinsured

3.1.2terminates,subjectto3.2and3.3below,eitherasthesubject-matterinsuredandastoanypartasthatpartisdischargedfromtheaircraftatthefinalplaceofdischarge,or

onexpiryof15dayscountingfrommidnightofthedayofarrivaloftheaircraftatthefinalplaceofdischarge,whichevershallfirstoccur;nevertheless,subjecttopromptnoticetotheUnderwritersandtoanadditionalpremium,suchinsurance

3.1.3reattacheswhen,withouthavingdischargedthesubject-matterinsuredatthefinalplaceofdischarge,theaircraftdepartstherefrom,and

3.1.4terminates,subjectto3.2and3.3below,eitherasthesubject-matterinsuredandastoanypartasthatpartisthereafterdischargedfromtheaircraftatthefinal(orsubstituted)placeofdischarge,or

onexpiryof15dayscountingfrommidnightofthedayofre-arrivaloftheaircraftatthefinalplaceofdischargeorarrivaloftheaircraftatasubstitutedplaceofdischarge,whichevershallfirstoccur.

3.2Ifduringtheinsuredtransittheaircraftarrivesatanintermediateplacetodischargethesubject-matterinsuredforon-carriagebyaircraftoroverseavessel,then,subjectto3.3belowandtoanadditionalpremiumifrequired,thisinsurancecontinuesuntiltheexpiryof15dayscountingformmidnightofthedayofarrivaloftheaircraftatsuchplace,butthereafterreattachesasthesubject0matterinsuredandastoanypartasthatpartisloadedonanon-carryingaircraftoroverseavessel.Duringtheperiodof15daystheinsuranceremainsinforceafterdischargeonlywhilstthesubject-matterinsuredandastoanypartasthatpartisatsuchintermediateplace.Ifthegoodsareon-carriedwithinthesaidperiodof15daysoriftheinsurancereattachesasprovidedinthisClause3.2

3.2.1wheretheon-carriageisbyaircraftthisinsurancecontinuessubjecttothetermsoftheseclauses,or

3.2.2wheretheon-carriageisbyoverseavessel,thecurrentInstituteWarClauses(cargo)shallbedeemedtoformpartofthisinsuranceandshallapplytotheon-carriagebysea.

3.3Iftheairtransitinthecontractofcarriageisterminatedataplaceotherthanthedestinationagreedtherein,thatplaceshallbedeemedtobethefinalplaceofdischargeandsuchinsuranceterminatesinaccordancewith3.1.2.Ifthesubject-matterinsuredissubsequentlyconsignedtotheoriginaloranyotherdestination,then,providednoticeisgiventotheUnderwritersbeforethecommencementofsuchfurthertransitandsubjecttoanadditionalpremium,suchinsurancereattaches

3.3.1inthecaseofthesubject-matterinsuredhavingbeendischarged,asthesubject-matterinsuredandastoanypartasthatpartisloadedontheon-carryingaircraftforthetransit;

3.3.2inthecaseofthesubject-matterinsurednothavingbeendischarged,whentheaircraftdepartsfromsuchdeemedfinalplaceofdischarge;thereaftersuchinsuranceterminatesinaccordancewith3.1.4.

3.4SubjecttopromptnoticetoUnderwriters,andtoanadditionalpremiumifrequired,thisinsuranceshallremaininforcewithintheprovisionsoftheseClausesduringanydeviation,oranyvariationoftheadventurearisingformtheexerciseofalibertygrantedtotheaircarrierunderthecontractofcarriage.

“overseavessel”shallbedeemedtomeanavesselcarryingthesubject-matterfromoneportorplacetoanotherwheresuchvoyageinvolvesaseapassagebythatvessel)

4Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.

5AnythingcontainedinthiscontractwhichisinconsistentwithClauses2.8,2.9or3shall,totheextentofsuchinconsistency,benullandvoid.

CLAIMS

6.6.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubjectmatterinsuredatthetimeoftheloss.

6.2Subjectto6.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.

7.7.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargoinsuredhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

7.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:TheagreedvalueofthecargoshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossandeffectedonthecargobytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurances.

BENEFITOFINSURANCE

8Thisinsuranceshallnotinuretothebenefitofthecarrierorotherbailee.

MINIMISINGLOSSES

9ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflossrecoverablehereunder

9.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,

9.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercisedandtheUnderwriterswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.

10MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.

AVOIDANCEOFDELAY

11ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.
